My son was the passenger in a car that was stopped by the police and searched.  The driver of the car had marijuana in his pocket.  When asked where he got the marijuana the driver told the police that my son had given it to him,  which was not true.

 Nevertheless, my son was arrested and charged with felony distribution of a controlled substance. 

 We could not believe this was happening.  How could the prosecutor file such a weak case?  We were sure the case would be thrown out of court immediately.  We were not so lucky.  My son was appointed a public defender who, in our opinion, did absolutely nothing other than to  immediately try to get my son to plead guilty.

 After several court appearances it was obvious that we needed to do something else.

 We researched attorneys practicing in Placer County on the internet and decided we wanted to talk to Dan Koukol.

 We met with Mr. Koukol and described the situation.  Almost immediately, through talking with Dan, we formulated a plan that outlined how the case should be investigated and handled.

 Long story short – it worked!   Mr. Koukol’s investigator got access to the driver’s cell phone and cell phone records.  From here he was able to determine who the driver had been in contact with and when.  The investigator then made contact with the driver’s girlfriend and was able to view and photograph text messages she had received from the driver describing when and where he had acquired the marijuana.  Perfect!

 Mr. Koukol presented this evidence to the prosecutor and the case against my son was dismissed. 

 I don’t think any of this was terribly difficult, in it seems to me, that this is was the needed course of action.  We’re just glad that we were able to find an attorney that understood the situation and was resourceful enough and motivated enough to handle it appropriately.

 I now go out of my way to recommend Dan Koukol when I hear about someone in trouble with the law.  Dan did exactly what he said he was going to do, and in our case it was an extreme success.

Thankfully, Mr. Koukol agreed to continue representing me on my case after it was moved into Federal court in Sacramento. After several months of meetings and negotiations, he was able to convince the prosecutor to a fairly painless resolution of my case.

In the end I was allowed to enter a plea to one misdemeanor. The only sentence I received was a small fine. Dan Koukol was able to convince the judge to allow me to terminate probation when I paid my fine. Dan really represented me well.  It is very scary to be prosecuted in Federal court , especially on a drug offense.

Thankfully, Dan Koukol knows how to navigate me through the federal system very well. When all was said and done I ended up with no jail time whatsoever and I was on probation for less than one hour!

If you need a criminal defense attorney who will really stick with you no matter what court you end up in, I highly recommend Dan Koukol.

In the end, Dan Koukol was able to negotiate a settlement that was much better than I expected. He also helped me recognize that I was on a bad path and helped me stop using drugs.

When I was in jail, Dan also helped me (big time) because he called the jail and convinced them that they were keeping me in custody longer than the court ordered. The co-defendant’s attorney just abandoned him, where as, Dan continued to fight for me. This was particularly important because the jail did not want to release me as the court had instructed so that I could finish my sentence on an alternative sentencing program.

Mr. Koukol was able to get the prosecutor and the judge to allow me to go into a drug program and then after I finish the program, the felony drug charge will be reduced to a misdemeanor. I hope to never get in trouble like this again.

To say that my family (and my wife) was scared would be a gross understatement. At times the stress caused us to become physically ill. Because of my wife’s prior record and the large quantity of drug involved in this case the prosecutor could have, at any time, turned the case into a mandatory life term case without the possibility of parole.  Mr. Koukol pursuaded him not to do this.

In fact, Mr. Koukol also helped us avoid a different sentencing minimum which is a “mandatory minimum” ten (10) year term. In the end my wife was sentenced to just over five years and she will receive a one year reduction in this sentence when she completes a drug program. After subtracting the credits she has already earned she will be home in just over three years!  Considering what we were expecting this is an unbelievable miracle.

After the Federal case was closed, Mr. Koukol went back to state court and asked the state court judge to terminate my wife’s probation on a different case, which he did. Now when she is released from Federal prison she will not have to go to court to deal with a probation violation – which would result in another prison term.  Not only does this save her a few more years it also makes things better for her while she is serving her  time on the Federal case because she will not have a “hold” on her – which would affect her security level (and her privileges).

I can absolutely, positively tell you that if you need a really good attorney; one that will work for you and one that can really deliver, you should hire Dan Koukol.

Over a year ago my husband and I were arrested for growing marijuana. The Federal Prosecutor elected to prosecute the case because it involved over 500 plants. 

I can tell you the whole experience was absolutely terrifying. I had never been in jail before and I found the jail to be very scary and very unpleasant. The guards were particularly mean to me because I had a disability.

I was arrested for being under the influence of a controlled substance, transporting a controlled substance and being in possession of a controlled substance for sale.  The police report said that I had over one quarter of a pound of methamphetamine along with several other illegal substances in my possession. 

When I went to court I was given a court appointed attorney.   After several court appearances this attorney told me that the best he could do was get me a state prison sentence.  This absolutely freaked me out because I knew that if I went to prison my daughter would be taken away from me and everything I had in the world would be lost. 

My boyfriend looked for a defense attorney in Rocklin and hired Dan Koukol  to represent me.  Mr. Koukol met with me several times and took the time to fully understand my situation.   He created a timeline of my life from the time I was 10 years old.  When Mr. Koukol was done he had documented my entire life story.  I have been in trouble before and I can say no attorney had ever taken the time to do this for me.

I went through 3 public defenders in Placer County in a year and a half while out on bail. I was continuously offered 5 years state prison with 80 percent to be served on the sentence before being eligible for parole. 

Since bailing out of jail I have been employed and doing better than ever. Dan said that he could not promise me anything but he would do everything possible to help.
